Northeast Delhi violence: Police approach court for waiver of cost of Rs 15,000
In a case involving the 2020 violence in Northeast Delhi, Delhi Police has asked the court to discharge fees in the amount of Rs. 15,000. The Station House Officer (SHO) Gokulpuri has moved the application.
In this case, the court has also requested a compliance report from the DCP.
The court’s ruling from August 8, 2022, states that the accused persons will receive a copy of this application for waiver of costs before the next hearing on August 18, 2022, so they can be heard on the issue of remission of costs.
The court has changed the earlier decision of August 6, 2022, instructing the Commissioner of Police to provide a compliance report, and has requested a compliance report from the Deputy Commissioner of Police (DCP).
The Court ruled that the decision of August 6, 2022, is hereby modified to require an investigation and report from the DCP (North East), rather than the deserving Commissioner of Police, in light of the fact that the DCP is the actual disciplinary and regulating authority.
The police stated that the DCP is the controlling authority with regard to the IO, SHO, and ACPs of the North East District and that he has already received a report on the conduct of the IO. In the absence of a deserving Commissioner of Police, a compliance report may be requested from the DCP under specific conditions. Additionally, a waiver of the $15,000 in costs was requested because the human error was a factor in the case.
The Commissioner’s report on the matter of recording police witnesses Constable Vipin and Head Constable Saroj’s statements on an incident that occurred on February 25, 2020, as opposed to February 24, 2020, was requested by the Court. The SHO argued that the IO, in this case, ought to have questioned these witnesses about the occurrence on February 24, 2020.
In order to amend the record in this case, Delhi Police also stated that it now aims to file a supplementary charge sheet after speaking with these witnesses regarding the occurrence of February 24, 2020.
