Jamie Foxx Faces Legal Action Over Alleged Sexual Assault in NYC Restaurant

Renowned US actor Jamie Foxx, born Eric Marlon Bishop, is now entangled in a legal battle following a woman’s lawsuit accusing him of sexual assault at a New York City restaurant nearly eight years ago. The accuser alleges that Foxx, in an intoxicated state, subjected her to unwanted advances after she approached him for a photograph at Catch NYC during the early hours of August 26, 2015. The lawsuit, which seeks damages for “sexual assault, abuse, assault, and battery,” portrays Foxx making inappropriate comments about the woman’s physique and fragrance. The incident reportedly came to a halt when her friend intervened.

The legal action does not solely target Foxx; it also encompasses Mark Birnbaum, the restaurant’s owner, who was allegedly seated with Foxx before the assault. The accuser argues that Birnbaum and the restaurant staff breached their duty of care by failing to prevent the assault. The lawsuit contends that the woman has endured severe emotional distress, anxiety, humiliation, embarrassment, and post-traumatic stress disorder due to the alleged “heinous acts.”

This legal manoeuvre emerges just before the expiration of the New York Adult Survivors Act on November 24, a law that empowers alleged victims of sex crimes to pursue legal action even after the statute of limitations has elapsed. Over the years, various high-profile figures, including former President Donald Trump, rapper Sean Combs, comedian Bill Cosby, actor Cuba Gooding Jr., and Russell Brand, have confronted legal challenges under this act.

Jamie Foxx, acclaimed for his stellar performance as Ray Charles in the 2004 film “Ray,” has not issued a public response to these grave allegations as of now. The lawsuit against Foxx contributes to the ongoing societal and industry-wide reckoning with sexual assault allegations, shedding light on the importance of addressing such issues in the public sphere.
